Welcome to Prozix! These Terms of Service (“Terms”) govern your use of our website, services, and products, including 3D printing, 3D scanning, and design services (collectively, “Services”) provided by Prozix LLC (“we,” “us,” or “our”). By accessing or using our Services, you agree to these Terms.

1. Use of Services

You must be at least 18 years old or have the consent of a legal guardian to use our Services.
You agree not to use our Services for illegal, harmful, or unauthorized purposes.
You are responsible for maintaining the confidentiality of any account credentials.

2. Orders & Payment

All quotes are subject to change based on material, labor, or technical requirements.
Payment is due before production unless otherwise agreed in writing.
Orders may be canceled only before production begins. Refunds are not guaranteed once material is used or labor has commenced.

3. Design Files & Intellectual Property

You affirm that you own or have the legal right to use any design or file you submit.
Prozix retains the right to refuse any print or design request that violates intellectual property or other applicable laws.
You retain full ownership of your original designs unless otherwise agreed.

4. Production & Delivery

Estimated lead times are not guaranteed and may vary based on workload and complexity.
Prozix is not responsible for delays due to third-party carriers or incorrect delivery information.

5. Quality & Revisions

Minor variations in color, texture, or finish are inherent in 3D printing and do not constitute defects.
Any quality concerns must be reported within 5 business days of delivery.
We reserve the right to assess and determine whether reprinting or refunds apply on a case-by-case basis.

6. Limitation of Liability and Indemnity

Prozix is not liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the use of our Services, including but not limited to loss of profits, business interruption, or loss of data, even if advised of the possibility of such damages.
In no event shall Prozix’s total liability, under any legal theory, whether in contract, tort (including negligence), strict liability, or otherwise, exceed the total amount paid by the customer for the specific service in question. This limitation applies regardless of the failure of the essential purpose of any limited remedy provided herein.
You agree to indemnify, defend, and hold harmless Prozix LLC, its officers, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement, or infringement by any other party using your account, of any intellectual property or other rights of any person or entity.

7. Privacy

Your data is handled in accordance with our Privacy Policy.
We do not sell or misuse customer data.

8. Changes to Terms

Prozix may update these Terms from time to time. Continued use of our Services constitutes acceptance of those changes.

9. Disclaimer of Warranties

All Services provided by Prozix are offered “as is” and “as available” without warranties of any kind, either express or implied.
Prozix disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be error-free, uninterrupted, secure, or free from viruses or other harmful components.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any disputes shall be resolved through binding arbitration in Los Angeles County, California.
